Nightlife & Venue Discovery Apps in Turkey: Alcohol Ads, KVKK, Marketing and Booking Rules (2026)

1. What changed in Türkiye’s alcohol advertising law in June 2026?
Türkiye already restricts advertising and promotion of alcoholic beverages. Law No. 7584, published in the Official Gazette on 20 June 2026, amended Article 6 of Law No. 4250. The Ministry of Agriculture and Forestry’s public notice confirms tightened rules around use of alcoholic-drink producer/importer/marketer names, trademarks, logos and packaging elements in sponsorship, publications, shares and event settings.
Read the Ministry’s 26 June 2026 explanation of the legal changes.
2. Can the app list bars, lounges, clubs and nightlife events?
Assess the content and commercial purpose rather than relying solely on the category “bar” or “nightlife”. A neutral factual directory describing a venue’s address, opening times, entertainment programme and booking contact has a different risk profile from an advert explicitly promoting alcoholic-drink consumption, alcohol discounts, specific beverage brands or sponsored campaigns. However, the mere absence of an alcohol product name is not a legal safe harbour: visual content, indirect promotion, paid placement and actual consumer effect should still be reviewed by Turkish advertising counsel.
| App content / feature | Regulatory review required |
|---|---|
| Venue name, location and entertainment programme | Assess whether factual discovery remains neutral and accurate and does not indirectly promote restricted products. |
| Paid premium venue listing | Check whether the paid creative, featured image, copy and audience targeting amount to restricted alcohol promotion. |
| Alcohol brand logo, banner or branded event sponsorship | High-risk under Law No. 4250 and the 2026 amendments; do not publish without case-specific Turkish legal clearance. |
| Happy-hour or drink-discount campaign | Potentially prohibited alcohol promotion or inducement; requires strict review, not general permission. |
| Ticket booking, table reservation or consumer payments | May require additional platform, consumer-distance-contract, payment and e-commerce analysis beyond advertising law. |
| User-generated event posts | Require moderation, takedown/escalation and advertising review policies for prohibited or misleading content. |
3. KVKK for mobile apps: location and behavioural data matter
A typical entertainment-discovery app may process user profiles, precise or approximate location, device identifiers, app activity, saved venues, event attendance interests and marketing preferences. The Turkish Personal Data Protection Law No. 6698 (KVKK) requires a lawful processing basis, appropriate transparency, data minimisation, security and rights procedures. A separate and valid consent mechanism may be required for some purposes; a generic terms-of-use click does not automatically satisfy all privacy and marketing rules.
The product team should map:
- Controller and processors: identify who determines purposes and means and which cloud, analytics, marketing or CRM providers handle the data.
- Location permissions: distinguish location necessary for a user-requested venue search from precise tracking or profiling that goes beyond that request.
- Analytics/ads SDKs: identify device identifiers, third-party sharing, cookie-like trackers and relevant lawful bases.
- User notices: explain categories of information, purposes, retention, recipients, rights and foreign transfers in an appropriate Turkish-language interface.
- Foreign-controller registration: determine whether VERBİS applies, whether an exception is available and, where required, how a representative will be appointed.
4. Sending Turkish user data to UAE cloud systems: the Article 9 transfer test
International transfers are governed by Article 9 of KVKK, significantly revised in 2024. The new regime provides adequacy-decision and appropriate-safeguard routes, including Turkish Data Protection Authority standard contracts and approved binding corporate rules. Where a standard contract is the chosen mechanism, the statute provides a five-business-day notification requirement following signature. Exceptions exist for occasional transfers, but they are not a blanket mechanism for routine overseas hosting of all Turkish users’ data.
The legal analysis should identify actual data flows and roles: UAE parent as controller, cloud providers as processors, whether separate Turkish agents access CRM records, and which transfer mechanism genuinely fits. Review the KVKK Act (English, Article 9) and English standard-contract documentation.
5. Email, SMS and push notifications: can you market Istanbul events to users?
Review Türkiye’s commercial electronic communication rules under Law No. 6563 and related regulations. For promotional emails and texts, consent and opt-out obligations may arise, and the İleti Yönetim Sistemi (İYS) provides the relevant consent-management infrastructure. A business contact exception or type of notification should be tested precisely; not every email or in-app message can be treated as transactional.
Segment marketing into: (a) notices essential to the requested service, (b) opted-in event alerts and promotional messages, (c) third-party venue advertisements and sponsored notifications. A marketing opt-in does not authorise otherwise prohibited promotion of alcoholic beverages.

6. What changes when the app starts accepting reservations or ticket payments?
A free listing directory may operate differently from an e-commerce intermediary that enables users to conclude distance contracts with venues or event organisers. When the app facilitates paid transactions, additional pre-contract disclosure, platform liability, cancellation/refund and consumer complaint procedures can apply depending on the service and the legal role of the platform. Do not assume that a redirect to a third-party venue and processing the entire booking in-app create identical obligations.
The Ministry’s August 2026 guidance specifically addresses how distance contracts and intermediary providers work through websites and mobile applications. See Distance Contract Information (17 August 2026). Review ETBİS registration guidance for the platform’s actual functions.
7. Launch checklist for founders and product counsel
- Create a content policy distinguishing neutral venue information, sponsored posts, alcohol-associated creative and forbidden promotions.
- Collect sample screenshots for every monetisation flow and run legal review before paid venue advertising goes live.
- Write venue terms specifying who may upload images, event banners and descriptions, with review and takedown rights.
- Prepare user privacy notices, location consent/permissions, processor contracts, security controls and foreign-transfer assessments.
- Review VERBİS and Turkish representative requirements, including relevant statutory exemptions.
- Design marketing consent and unsubscribe processes, including the appropriate IYS workflows.
- Decide whether the platform takes bookings, tickets or payments and map the applicable consumer-protection obligations.
- Confirm Turkish tax consequences for venue subscriptions and sponsored promotion; assess local sales representatives and PE.

Frequently asked questions
Is a nightlife discovery app illegal in Turkey?
No universal rule makes the concept illegal solely because it lists nightlife venues, but the platform’s marketing creative, paid placement, operational functions and regulatory classification must be assessed.
Can an app show alcohol brand logos as part of a sponsored event?
This is a high-risk category under amended Law No. 4250; the June 2026 rules expressly restrict relevant brand/logo uses in event support and publications. Obtain Turkish legal clearance before any such creative appears.
Does the 20 June 2027 deadline let us promote alcoholic beverages online until then?
No. The Ministry’s announcement distinguishes the physical workplace display transition from relevant event/publication/share restrictions that took effect in June 2026.
Is a foreign mobile application exempt from KVKK?
No blanket exemption exists merely because the company or servers are abroad. Applicability, VERBİS exceptions and transfer mechanisms require review of the actual processing activity.
Is a marketing consent sufficient for all sponsored push notifications?
No. Commercial communication permission and product-specific advertising prohibitions are separate legal tests.
Does allowing users to pay for event tickets change our obligations?
Potentially. A payment or booking function can bring consumer distance-contract and electronic-commerce rules into scope, in addition to VAT, accounting and tax classification.
